Il 19 luglio 1985 in val di Stava (nel Comune di Tesero, in provincia di Trento) è crollata una discarica di rifiuti dell’attività mineraria composta da due bacini realizzati e accresciuti nell’arco di oltre 20 anni per decantare, consolidare e stoccare i fanghi sterili residuati dall’arricchimento mediante flottazione della fluorite estratta dalla vicina miniera di Prestavèl e da altre miniere di fluorite del Trentino, dell’Alto Adige e della Lombardia.

On 19 July 1985 in Val di Stava (in the Municipality of Tesero, in the province of Trento) a mining waste landfill collapsed, consisting of two basins built and enlarged over a period of over 20 years to settle, consolidate and store the sterile sludge residual from the enrichment by flotation of fluorspar extracted from the nearby Prestavèl mine and from other fluorspar mines in Trentino, Alto Adige and Lombardy.
Il cimitero delle Vittime della val di Stava, indicato da apposita segnaletica stradale, si trova nella parte superiore dell’abitato di Tesero, di fianco alla Chiesa di San Leonardo, a tre chilometri circa di distanza da Stava, all’inizio di Tesero venendo da Stava.

The cemetery of the Victims of the Val di Stava, indicated by special road signs, is located in the upper part of the town of Tesero, next to the Church of San Leonardo, about three kilometers away from Stava, at the beginning of Tesero coming from He was.
All’epoca dei fatti la Chiesa di San Leonardo era in stato di abbandono e non era consacrata. Dopo la catastrofe venne ristrutturata e nuovamente consacrata.

La Commissione ministeriale d’inchiesta ed i periti nominati dal Tribunale di Trento hanno accertato che “tutto l’impianto di decantazione costituiva una continua minaccia incombente sulla vallata”. “L’impianto è crollato essenzialmente perché progettato, costruito, gestito in modo da non offrire quei margini di sicurezza che la società civile si attende da opere che possono mettere a repentaglio l’esistenza di intere comunità umane. L’argine superiore in particolare era mal fondato, mal drenato, staticamente al limite. Non poteva che crollare alla minima modifica delle sue precarie condizioni di equilibrio”.

The ministerial commission of inquiry and the experts appointed by the Court of Trento ascertained that “the entire settling plant constituted a continuous threat looming over the valley”. “The plant collapsed essentially because it was designed, built and managed in such a way as not to offer those safety margins that civil society expects from works that can jeopardize the existence of entire human communities. The upper embankment in particular was poorly founded, poorly drained and statically at its limit. It could only collapse at the slightest change in its precarious conditions of equilibrium.”

Il monumento in bronzo, opera dell’artista locale Felix Deflorian, dono dei “vicini” della Magnifica Comunità di Fiemme, è fiancheggiato da quattro lastre di porfido con i nomi delle 268 Vittime di Stava e da due Croci di bronzo.

The bronze monument, the work of local artist Felix Deflorian, gift from the “neighbors” of the Magnificent Community of Fiemme is flanked by four porphyry slabs with the names of the 268 Victims of Stava and two bronze crosses.

Le lapidi, tutte uguali, indicano la sepoltura delle Vittime della catastrofe di Stava: si tratta per gran parte di Vittime che all’epoca erano residenti a Tesero, giacché la maggior parte delle salme riconosciute delle Vittime residenti all’epoca in altri Comuni vennero tumulate nei luoghi di residenza.

The gravestones, all the same, indicate the burial of the Victims of the Stava catastrophe: these are mostly Victims who were residents of Tesero at the time, since most of the recognized bodies of the Victims resident at the time in other Municipalities were buried in places of residence.
Già in occasione dell’Angelus di domenica 21 luglio 1985 il Santo Padre Papa Giovanni Paolo II si strinse nel dolore alla comunità di Tesero, ai superstiti e ai familiari e pregò per le Vittime innocenti della catastrofe di Stava. Il 17 luglio 1988 Papa Giovanni Paolo II, pellegrino a Stava e a Tesero, sostò in preghiera nella Chiesa di San Leonardo e, nel visitare il cimitero delle Vittime, rimase in ginocchio, per alcuni lunghi interminabili minuti, aggrappato ad una delle Croci in bronzo.

Already on the occasion of the Angelus on Sunday 21 July 1985, the Holy Father Pope John Paul II grieved the community of Tesero, the survivors and their families and prayed for the innocent victims of the Stava catastrophe. On 17 July 1988 Pope John Paul II, a pilgrim to Stava and Tesero, stopped in prayer in the Church of San Leonardo and, when visiting the cemetery of the Victims, remained on his knees, for a few long interminable minutes, clinging to one of the bronze crosses.
Il Cimitero di San Leonardo è la voce di un martirio che guarda al mondo. Lo struggente monumento alle Vittime riapre le ferite di chi porta un fiore, ma ferma negli occhi di ogni pellegrino gli istanti di quello che fu.

Il processo di primo grado si svolse a Trento e si concluse l’8 luglio 1988 con la condanna di 10 imputati giudicati colpevoli dei reati di disastro colposo e omicidio colposo plurimo e cioè: i responsabili della costruzione e gestione del bacino superiore che crollò per primo: i direttori della miniera e alcuni responsabili delle società che intervennero nelle scelte circa la costruzione e la crescita del bacino superiore dal 1969 al 1985, i responsabili del Distretto minerario della Provincia Autonoma di Trento che omisero del tutto i controlli sulla discarica. Il procedimento penale si è concluso dopo altri 4 gradi di giudizio con la seconda sentenza della Corte di Cassazione, emessa il 22 giugno 1992, che ha confermato le condanne pronunciate in primo grado. Le pene di reclusione sono state ridotte e condonate nel corso dei vari gradi di giudizio. Nessuno dei condannati ha scontato la pena detentiva. Vennero condannate al risarcimento dei danni in veste di responsabili civili per la colpa dei loro dipendenti: le società che nello stesso periodo ebbero in concessione la miniera di Prestavèl o intervennero nelle scelte relative alla discarica: Montedison S.p.A., Industria marmi e graniti Imeg S.p.A. per conto della Fluormine S.p.A., Snam S.p.A. per conto della Solmine S.p.A., Prealpi Mineraria S.p.A. e la Provincia Autonoma di Trento.

The first degree trial took place in Trento and concluded on 8 July 1988 with the conviction of 10 defendants found guilty of the crimes of manslaughter and multiple manslaughter, namely: those responsible for the construction and management of the upper basin which collapsed first : the directors of the mine and some managers of the companies who intervened in the choices regarding the construction and growth of the upper basin from 1969 to 1985, the managers of the mining district of the Autonomous Province of Trento who completely omitted controls on the landfill. The criminal proceedings concluded after another 4 degrees of judgment with the second sentence of the Court of Cassation, issued on 22 June 1992, which confirmed the sentences pronounced in the first degree. Prison sentences were reduced and pardoned during the various levels of trial. None of the convicts served their prison sentences. The following were sentenced to compensation for damages as civilly liable for the fault of their employees: the companies that in the same period had the Prestavèl mine under concession or intervened in the choices relating to the landfill: Montedison S.p.A., Industria marmi e graniti Imeg S.p.A. on behalf of Fluormine S.p.A., Snam S.p.A. on behalf of Solmine S.p.A., Prealpi Mineraria S.p.A. and the Autonomous Province of Trento.
La necessità di dare sepoltura ad un gran numero di persone contemporaneamente obbligò gli amministratori dell’epoca a recuperare il cimitero non più utilizzato che fiancheggia l’antica Chiesa di San Leonardo e a realizzare un nuovo cimitero dove vennero sepolte le 71 salme che non poterono essere riconosciute.

The need to bury a large number of people at the same time forced the administrators of the time to recover the no longer used cemetery that flanks the ancient Church of San Leonardo and to create a new cemetery where the 71 bodies that could not be recognized were buried.
Il risarcimento del danno di 739 danneggiati per complessivi oltre 132 milioni di Euro è stato liquidato quasi per intero in via transattiva nel 2004 da Edison per conto di Montedison (31%), Eni-Snam per conto di Solmine (26%), Finimeg per conto di Imeg e Fluormine (16%) e Provincia Autonoma di Trento (27%). Prealpi Mineraria, nel frattempo fallita, non ha versato alcuna somma ai danneggiati. Il risarcimento per la perdita di vite umane è stato quantificato come quello per infortuni stradali. Nell’ambito della transazione sono stati interamente rimborsati gli importi anticipati dallo Stato e dalla Provincia Autonoma di Trento per i soccorsi, il ripristino e la ricostruzione.

The compensation for the damage of 739 injured parties for a total of over 132 million Euros was paid almost entirely in a settlement in 2004 by Edison on behalf of Montedison (31%), Eni-Snam on behalf of Solmine (26%), Finimeg on behalf of account of Imeg and Fluormine (16%) and the Autonomous Province of Trento (27%). Prealpi Mineraria, which in the meantime went bankrupt, did not pay any sum to the injured parties. Compensation for loss of life was quantified as compensation for road accidents. As part of the transaction, the amounts advanced by the State and the Autonomous Province of Trento for relief, restoration and reconstruction were fully reimbursed.
Al di là delle azioni e omissioni penalmente rilevanti, concorsero al disastro di Stava una serie di comportamenti che vanno oltre la sfera giuridica e si caratterizzano principalmente nell’aver anteposto alla sicurezza dei terzi la redditività economica degli impianti sia da parte delle società concessionarie che degli Enti pubblici istituzionalmente preposti alla tutela del territorio e della sicurezza delle popolazioni.

Beyond the criminally relevant actions and omissions, a series of behaviors contributed to the Stava disaster that go beyond the legal sphere and are mainly characterized by placing the economic profitability of the plants before the safety of third parties, both on the part of the concessionaire companies and the Public bodies institutionally responsible for the protection of the territory and the safety of the populations.
Venne sottoposta a dura censura da parte dei giudici, anche se non fu giudicata rilevante dal punto di vista penale, la condotta di numerosi Uffici pubblici e dei costruttori e gestori del bacino inferiore. La condotta degli amministratori pubblici e dei titolari delle società concessionarie non fu giudicata penalmente rilevante perché essi affidano gli aspetti tecnici a dipendenti con adeguate conoscenze.

The conduct of numerous public offices and the builders and managers of the lower basin was subjected to harsh censure by the judges, even if it was not considered relevant from a criminal point of view. The conduct of the public administrators and the owners of the concessionaire companies was not judged criminally relevant because they entrusted the technical aspects to employees with adequate knowledge.
